In some recent procurement processes, banks have – according to the tender document - not been allowed to support more than one bidder due to fears of conflict of interests. This means that some Private Partners have difficulties in finding a credit institution that is not exclusively bound to a different bidder. This exclusivity can be caused by different circumstances: On one hand some offices for awarding expect exclusivity to ensure that the competition can be carried out confidentially. On the other hand some bidders try to achieve a competitive advantage by obtaining an exclusive agreement with one particular credit institution.
The Task Force invited market players to a workshop on the 1st of October 2009 to find out whether or not this is allowed or whether this is in fact a legal requirement.
The workshop was conducted and its conclusion summarized by Prof Dr Martin Burgi, head of the Research Institute for Modernisation of Administrative Law and Public Procurement Law at the Ruhr University Bochum. Over the last few years the PPP Task Force has published several guidelines on different aspects of PPP. The following list gives an overview of some of these guidelines:
This last handout is designed especially for public authorities who need to use the support of consultants for the realisation of a PPP project. The whole process of a European wide tender for advisory services is outlined. It contains information about the legal requirements concerning the output specification the evaluation criteria for the prequalification and the final bid. In addition examples of different procedures are given.
